This resolution stems from a lawsuit initiated by Clear Blue concerning the fraudulent reinsurance letters of credit orchestrated by insurtech company Vesttoo, as confirmed by various market sources.

Clear Blue Insurance had previously filed a lawsuit against Aon in New York state in late 2023, aiming to recuperate damages resulting from the illicit activities. The fraud left Clear Blue facing substantial challenges after it relied on fabricated letters of credit from Vesttoo as collateral for reinsurance agreements it facilitated. While Clear Blue managed to maintain its operational integrity, the financial impact was undeniable, leading the company to pursue compensation from parties allegedly involved in introducing its services to the Vesttoo transactions.

Following an active legal period marked by motions for dismissal and amended complaints, with both parties intensifying their rhetoric, the lawsuit recently went quiet. This silence prompted speculation among industry contacts that a settlement was imminent. Although the specifics of the agreement remain confidential, and requests for comment from both Aon and Clear Blue were not met by publication, it is understood that the resolution was reached amicably. Both companies reportedly prioritized the preservation of their commercial ties, seeking to put the unfortunate Vesttoo episode behind them. This settlement echoes a previous agreement Aon made with Porch Group in early 2024, which also concerned Vesttoo-related fraud exposures. Aon had proactively set aside a $197 million legal settlement expense reserve in its Q4 2023 results, anticipating such resolutions. The dismissal of the Clear Blue case with prejudice effectively closes this chapter, preventing any further legal action on the same claims. Attention now shifts to remaining legal proceedings targeting China Construction Bank and those connected to the Vesttoo bankruptcy trust creditors, as other related cases, including one against Gallagher Re, have also been previously dismissed.
